Genus AI and its affiliates (collectively referred to as “Genus AI”, “we”, “us”) takes its data protection responsibilities seriously. This Privacy Notice explains who we are, how we collect, use and share Personal Data about you, and how you can exercise your privacy rights. It applies to all individuals who access our website(s), engage in our products and/or services (“Services”), or who participate in our recruitment activities. The Genus AI entity responsible for your Personal Data will be the member of Genus AI that originally collects your information. This will be explained at the point at which your Personal Data is first collected by the Genus AI entity, for example where you or the business you work for engages us to provide a service or where we engage you to provide a service to us.

We collect and use information about you if you:

Use of our website(s) or online services

When you engage our Services, we collect and use Personal Data which is necessary for the performance of those Services. The majority of the Personal Data we collect and use to provide our Services is supplied voluntarily by our customers and business partners. Because of this, if you are a customer or business partner of Genus AI then it will be generally obvious to you what Personal Data we collect and use. This information may include:

  • Basic information such as your name, the company you work for, your position and your relationship to a person;
  • Contact information such as postal address, email address and telephone number(s);
  • Financial information (such as bank account information, tax registration information, billing details) in order to manage and process any payments you make to us;
  • Information held by credit references agencies and fraud prevention agencies, in order to assess any application for your use of our services;
  • Identification and background information provided by you or collected as part of our business validation process; and
  • Information and feedback you provide to us about our products and services in order to continuously improve the products and services.

Potential customer

We collect information directly, from other members of the Genus AI group, and from other third party lead providers about organizations who might like to hear from us or receive our products and services. We will only do so in accordance with your preferences and as described in this Privacy Notice.

Specifically we may collect:

  • Basic identification and contact information (such as your name, telephone number, and email address) in order to fulfill any order, provide our Services and manage your account;
  • Demographic information such information about your occupation;

How We Use Personal Data

We use the Personal Data we collect in the following ways and where we are satisfied that we have an appropriate legal basis to do so.

Use of our website(s) or online services

  • Providing our websites: We process your Personal Data to perform our contract with you for the use of our websites and to fulfill our obligations under applicable terms of use/service. Where we have not entered into a contract with you, we base the processing of your Personal Data on our legitimate interest to operate and administer our websites and to provide you with the content you access and request (e.g., to download content from our websites);
  • Providing necessary functionality: We process your Personal Data to perform our contract with you for the use of our websites. Where we have not entered into a contract with you, we base the processing of your Personal Data on our legitimate interest to provide the necessary functionality required during your use of our websites;
  • Developing and improving our websites: We process your Personal Data to analyze trends and to track your usage of and interactions with our websites to the extent it is necessary for our legitimate interest in developing and improving our websites and providing our users with more relevant content, or where we seek your valid consent;

  • Assessing and improving user experience: We process device and usage data, which in some cases may be associated with your Personal Data, in order to analyze trends in order to assess and improve the overall user experience to the extent it is necessary for our legitimate interest in assessing and improving our Services offering, or where we seek your valid consent;
  • Promoting the security of services: We process your Personal Data by tracking the use of our Services, creating aggregated, non-personal data, verifying accounts and activity, investigating suspicious activity and enforcing our terms and policies, to the extent this is necessary for our legitimate interest in promoting the safety and security of the Services, systems and applications and in protecting our rights and the rights of others;
  • Managing user registrations: If you have registered for an account with us, we process your Personal Data by managing your user account for the purpose of performing our contract with you according to applicable terms of service;
  • Handling contact and user support requests: If you request customer support, or if you contact us by other means including via a phone call, we process your Personal Data to perform our contract with you and to the extent it is necessary for our legitimate interest in fulfilling your requests and communicating with you;
  • Managing event registrations and attendance: We process your Personal Data to plan and host events or webinars for which you have registered or that you attend, including sending related communications to you, to perform our contract with you;
  • Managing contests or promotions: If you register for a contest or promotion, we process your Personal Data to perform our contract with you. Some contests or promotions have additional rules containing information about how we will process your Personal Data;
  • Managing Payments: If you have provided financial information to us, we process your Personal Data to verify that information and to collect payments to the extent that doing so is necessary to complete the transaction and perform our contract with you;
  • Reviewing compliance with applicable usage terms: We process your Personal Data to review compliance with the applicable usage terms in our customer’s contract to the extent that it is in our legitimate interest to ensure adherence to the relevant terms;
  • Complying with legal obligations: We process your Personal Data when cooperating with public and government authorities, courts or regulators in accordance with our legal obligations under applicable laws to the extent this requires the processing or disclosure of Personal Data to protect our rights or is necessary for our legitimate interest in protecting against misuse or abuse of our websites, protecting personal property or safety, pursuing remedies available to us and limiting our damages, complying with judicial proceedings, court orders or legal processes or to respond to lawful requests.

Potential customer

  • Identifying customer opportunities: We process your Personal Data to assess new potential customer opportunities to the extent that it is in our legitimate interest to ensure that we are meeting the demands of our customers and their users’ experiences;
  • Registering office visitors: We process your Personal Data for security reasons, to register visitors to our offices and to manage non-disclosure agreements that visitors may be required to sign, to the extent such processing is necessary for our legitimate interest in protecting our offices and our confidential information against unauthorized access;
  • Sending marketing communications: We will process your Personal Data to send you marketing information, product recommendations and other non-transactional communications (e.g., marketing newsletters, telemarketing calls, SMS, or push notifications) about us and our affiliates and partners, including information about our products, promotions or events as necessary for our legitimate interest in conducting direct marketing or to the extent you have provided your prior consent;

Sharing Your Personal Data

We may share your Personal Data and other information with certain third parties for the purposes of operating our business, delivering, improving, and customizing our Services, sending marketing and other communications related to our business, and other legitimate purposes permitted by applicable law or otherwise with your consent. We may disclose your Personal Data in the following circumstances:

  • Genus AI Global Affiliates: for the purpose of data processing or storage.
  • Vendors and Service Providers: To assist us in meeting business operations needs and to perform certain services and functions your Personal Data may be shared with third-party providers of hosting, email communication and customer support services, analytics, marketing, advertising. For more details on the third parties that may place cookies through our Services, please see the “Cookies” section below. Following our instructions, these parties may access, process or store Personal Data in the course of performing their duties for us.
  • Business Transfers: If we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of all or a portion of our assets, or transition of a service to another provider, your Personal Data and other information may be transferred to a successor or affiliate as part of that transaction.
  • Legal Requirements: If required to do so by law, applicable regulation or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect and defend our rights or property, (iii) act in urgent circumstances to protect the personal safety of users of the Website or the public, or (iv) protect us or our affiliated companies against legal liability.

Data Retention

We will keep your Personal Data for as long as reasonably necessary for the purposes for which it was collected, as described in this Privacy Notice. In some circumstances we may store your Personal Data for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, or accounting requirements. In specific circumstances we may store your Personal Data for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your Personal Data or dealings.

Your Choices and Rights

Genus AI respects your rights in how your Personal Data is used and shared. You may request access or corrections to your personal Information and make choices about the kinds of marketing materials you receive (or choose not to receive marketing from Genus AI at all).

We may ask you for additional information to confirm your identity and for security purposes, before disclosing the Personal Data request to you. We reserve the right to charge a fee where permitted by law.

You can exercise your rights by using one of the methods in the “Contact Us” section. Subject to legal and other permissible considerations, we will make every reasonable effort to honor your request promptly or inform you if we require further information in order to fulfill your request. We may not always be able to fully address your request, for example if it would impact the duty of confidentiality we owe to others, or if we are legally entitled to deal with the request in a different way.

Access, Correction or Deletion of Your Information

If you would like to correct or update your Personal Data, or to request access to or deletion of your Personal Data, you may contact us by using one of the methods listed in the “Contact Us” section below including your name, email address, account identification, and purpose of the request. If you request a change to or deletion of your Personal Data, please note that we may still need to retain certain information for recordkeeping purposes, and/or to complete any transactions that you began prior to requesting such change or deletion (e.g., when you make a purchase or enter a promotion, you may not be able to change or delete the Personal Data provided until after the completion of such purchase or promotion). Some of your information may also remain within our systems and other records where necessary for compliance with applicable law.

At your request and where the law requires us to do so, we will confirm what Personal Data we hold about you. You may also have a legal right to obtain a copy of your Personal Data. You can make such a request by making a written request in one of the ways described in the “Contact Us” section below. We may charge a processing fee for this service where permitted by law and we will require evidence of your identity before fulfilling your request.

Advertising and Marketing Choices

We give you choices regarding our use and disclosure of your Personal Data for advertising and marketing purposes. You may access or update your contact details and modify your communication preferences by using one of the following methods in the Contact Us” section below. You can ask us to stop sending email marketing, by following the ‘unsubscribe’ link found on all email marketing message we send you. Please also note that if you choose not to receive marketing from us, we may still send you communications related to your Genus AI Services, such as information about a security update, billing issue or product delivery. Some advertising content is delivered through the Genus AI Services’ (including our website) use of cookies and related tracking technologies.  Our Cookie Notice includes more information on Genus AI’s use of such technologies and how you can modify or reject their use.

European Union (EU) Users

This section provides information on your rights under EU law (for these purposes, reference to the EU also includes the European Economic Area countries of Iceland, Liechtenstein and Norway). Genus AI’s role as a data controller or data processor will depend on the Service. For example, we are the data controller with regards to the use of our website(s) and a data processor with regards to the use of our platform by our customers.

Subject to EU law, you have the following rights in relation to your Personal Data:

  • Right of access: If you ask us, we will confirm whether we are processing your Personal Data and, if so, provide you with a copy of that Personal Data along with certain other details. If you require additional copies, we may need to charge a reasonable fee.
  • Right to rectification: If your Personal Data is inaccurate or incomplete, you are entitled to ask that we correct or complete it. If we shared your Personal Data with others, we will tell them about the correction where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so you can contact them directly.
  • Right to erasure: You may ask us to erase your Personal Data in some circumstances, such as where we no longer need it or you withdraw your consent (where applicable). If we shared your data with others, we will alert them to the need for erasure where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data with so you can contact them directly.
  • Right to restrict processing: You may ask us to restrict or ‘block’ the processing of your Personal Data in certain circumstances, such as where you contest the accuracy of the data or object to us processing it (please read below for information on your right to object). We will tell you before we lift any restriction on processing. If we shared your Personal Data with others, we will tell them about the restriction where possible. If you ask us, and where possible and lawful to do so, we will also tell you with whom we shared your Personal Data so you can contact them directly.
  • Right to data portability: You have the right to obtain your Personal Data from us that you consented to give us or that was provided to us as necessary in connection with our contract with you. We will give you your Personal Data in a structured, commonly used and machine-readable format. You may reuse it elsewhere.
  • Right to object: You may ask us at any time to stop processing your Personal Data, and we will do so:If we are relying on a legitimate interest (described under the “How We Use Personal Data” section above) to process your Personal Data — unless we demonstrate compelling legitimate grounds for the processing; or if we are processing your Personal Data for direct marketing.
  • Rights in relation to automated decision-making and profiling: You have the right to be free from decisions based solely on automated processing of your Personal Data, including profiling, unless this is necessary in relation to a contract between you and us or you provide your explicit consent to this use.
  • Right to withdraw consent: If we rely on your consent to process your Personal Data, you have the right to withdraw that consent at any time, but this will not affect any processing of your data that has already taken place.
  • Right to lodge a complaint with the data protection authority: If you have a concern about our privacy practices, including the way we handled your Personal Data, you can report it to the data protection authority that is authorized to hear those concerns.

Legitimate Interest. “Legitimate interests” means our interests in conducting our business, managing and delivering the best Services to you. This Privacy Notice describes when we process your Personal Data for our legitimate interests, what these interests are and your rights. We will not use your Personal Data for activities where the impact on you overrides our interests, unless we have your consent or those activities are otherwise required or permitted by law.

Changes. We will notify you of changes to the data processing activities described in this Privacy Notice by posting a prominent notice on the Website or the Apps or as otherwise required by law.

Job Applicants

Genus AI collects information from and about candidates in connection with available employment opportunities at Genus AI. This information may include resumes, identification documents, academic records, work history, employment and references. Genus AI uses your Personal Data to match your skills, experience and education with specific roles. For more information you may contact us by using one of the methods listed in the “Contact Us” section below.

Children

Our Services are designed for those 18 years of age or older. We do not knowingly collect Personal Data from children under the age of 13 (or other age as may be restricted under local law). If you have reason to believe that a child under the age of 13 has provided Personal Data to us through our Services, please contact us and we will endeavor to delete that information from our databases.

Security

We intend to protect the Personal Data entrusted to us and treat it securely in accordance with this Privacy Notice. Genus AI implements physical, administrative, and technical safeguards designed to protect the Personal Data from unauthorized access, disclosure, alteration, or destruction. However, no method of transmission over the internet is 100% secure. Therefore, while we strive to protect your data, we cannot ensure or warrant its absolute security.

Cookies and other similar technologies

We collect information about how you interact with our website(s) and some Genus AI Services through the use of cookies, pixel tags, and other similar technologies.
